Terms of Use

These terms govern your use of the Nearer mobile app ("the app"), provided by Palash Akhenia, operating as Octakris, Rajkot, Gujarat, India ("we", "us"). By installing or using the app you agree to these terms.

1. Who can use Nearer

You must be at least 18 years old. The app contains conversation prompts about relationships and intimacy that are meant for adults.

2. What the app is, and is not

Nearer provides conversation prompts to help partners talk. It is for entertainment and personal connection only. It is not therapy, counselling, medical, or professional relationship advice. If you are in a difficult or unsafe relationship, please contact a qualified professional or local support services.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on your devices for non-commercial purposes. You may not copy, modify, reverse engineer, resell, or extract the question content from the app, or use it to build a competing product.

4. Purchases

Some packs are unlocked through a one-time in-app purchase processed by Google Play. Prices are shown in the app and may vary by country and currency. Payment, refunds, and cancellations are governed by Google Play's terms and policies. You can restore previous purchases on a new device using the same Google Play account. We may change prices or the contents of packs for future purchases.

5. Acceptable use

Do not use the app unlawfully, attempt to bypass purchases, interfere with the app's operation, or use it to harass or pressure another person. Prompts are optional: no one should be pushed to answer a question they are uncomfortable with.

6. Intellectual property

The app, its design, and its content are owned by us or our licensors and are protected by copyright and other laws. All rights not expressly granted are reserved.

7. Disclaimer

The app is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the app will be uninterrupted or error free, or that it will improve any relationship.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for the app in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Changes and termination

We may update the app or these terms. Continued use after an update means you accept the new terms. We may suspend access if you breach these terms. You can stop using the app at any time by uninstalling it.

10. Governing law

These terms are governed by the laws of India. Courts in Rajkot, Gujarat have jurisdiction over disputes, subject to any mandatory consumer rights you have in your country of residence.
